Acceptable Use Policy — Consulting Cockpit

1. Purpose and Scope
This Acceptable Use Policy (“AUP”) governs your use of the Consulting Cockpit platform operated by GRAN Software Solutions GmbH (“GRAN”, “we”, “us”, or “our”). It forms an integral part of your contractual relationship with us.
By using Consulting Cockpit, you agree to comply with this AUP.
2. Prohibited Uses
You may not use Consulting Cockpit, nor permit or encourage others to use it, for any of the following activities:
a) Illegal Activity. Any use that violates applicable law or regulation, including but not limited to data protection laws (GDPR, BDSG), anti-money laundering laws, fraud, or tax evasion.
b) Unauthorized Access. Attempting to access, probe, scan, or test the vulnerability of any system, network, or account owned or operated by GRAN or any other user without express written authorization. This includes penetration testing, port scanning, credential stuffing, and session hijacking.
c) Interference with Others. Interfering with, disrupting, or degrading the service, servers, or networks connected to Consulting Cockpit, including denial-of-service attacks, resource exhaustion, and deliberate introduction of malware.
d) Spam and Phishing. Transmitting unsolicited bulk communications, phishing messages, or any content that impersonates GRAN, its employees, or other users.
e) Scraping and Crawling. Systematically retrieving data from Consulting Cockpit to create or compile a database, directory, or similar collection of user data without our prior written consent. This includes using bots, scrapers, or automated scripts beyond the scope of our API.
f) API Abuse. Exceeding the documented rate limits, creating multiple API keys to circumvent rate limits, or using API access for purposes other than integrating with Consulting Cockpit.
g) Harmful Content. Uploading, storing, or transmitting any content that:
- Contains malware, ransomware, or other malicious code;
- Infringes any third-party intellectual property or proprietary rights;
- Violates applicable data protection laws (e.g., uploading personal data without a lawful basis);
- Is defamatory, obscene, or otherwise unlawful in your jurisdiction.
h) Circumvention. Bypassing or attempting to bypass any access controls, authentication mechanisms, rate limits, encryption, or other security measures employed by Consulting Cockpit.
i) Impersonation. Creating accounts or organizations that impersonate another person, entity, or brand, or that are used for deceptive purposes.
j) Unauthorized Commercial Use. Reselling, sublicensing, or timesharing access to Consulting Cockpit or its features without our prior written consent.
3. User-Generated Content
You are solely responsible for all content you submit, upload, or store in Consulting Cockpit, including time entries, client records, project data, invoice data, and uploaded files.
You represent and warrant that:
- You have all necessary rights and consents to store and process such content;
- Your content does not violate any applicable law, including data protection law;
- Your content does not contain any viruses, malware, or other harmful components.
GRAN reserves the right (but not the obligation) to review and remove any content that violates this AUP or applicable law, without liability to you.
4. Security Obligations
As a user of Consulting Cockpit, you must:
- Maintain the confidentiality of your login credentials and API keys;
- Not share your account with unauthorized persons;
- Notify us immediately at hello@gransoftware.de if you suspect any unauthorized use of your account or a security breach;
- Use reasonable technical and organizational measures to protect your own systems and data when interacting with Consulting Cockpit.
5. Monitoring and Enforcement
GRAN reserves the right, without limiting its other remedies, to:
- Monitor your use of Consulting Cockpit for compliance with this AUP;
- Suspend or terminate your access, with or without notice, if we reasonably believe you have violated this AUP;
- Remove, disable access to, or delete any content that violates this AUP;
- Report suspected violations of law to relevant authorities and cooperate with their investigations.
A violation by any member of your organization may result in action against the entire organization account.
6. Reporting Violations
If you become aware of any violation of this AUP by another user, please report it to hello@gransoftware.de.
7. Changes to This Policy
We may update this AUP from time to time. Material changes will be communicated to you via email or through the platform at least 14 days before they take effect. Your continued use of Consulting Cockpit after the effective date constitutes acceptance of the updated AUP.
8. Governing Law and Jurisdiction
This AUP is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Any disputes arising from or in connection with this AUP shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
